Wednesday, June 11, 2025 Rezone Local Law and Special Use Permit Public Hearings

A meeting will be held on Wednesday, June 11, 2025 at 6:00 p.m., before the Henrietta Town Board to hear all persons with regards to the following request to Rezone the property and an Application for a Special Use Permit as follows:

• Proposed Local Law to Rezone approximately 40.369 acres of land located on West Henrietta Road and Erie Station Road, being a single parcel with Tax ID No. 189.01-1-19.2, from Industrial (with Specifics) to Residential, R-2-15, or as more particularly described in plans on file in the Town Clerk’s Office; and 

• Special Use Permit Application No. 2025-021: Erie Station / West Henrietta Road Multifamily Development by FSI 5500 LLC – Erie Station Road (near 5500 West Henrietta Road), to construct a multifamily housing development, in an Industrial Zoned District (proposed to be rezoned to a Residential R-2-15 Zoned District), Tax Account No. 189.01-1-19.2, or as more particularly described in plans on file in the Town Clerk’s Office.

The public hearing was held open and will be continued at the July 2, 2025 Town Board meeting.

Wednesday, July 2, 2025 Rezone Local Law and Special Use Permit Public Hearings

A meeting will be held on Wednesday, July 2, 2025 at 6:00 p.m., before the Henrietta Town Board to hear all persons with regards to the following request to Rezone the property and an Application for a Special Use Permit as follows:

• Proposed Local Law to Rezone approximately 40.369 acres of land located on West Henrietta Road and Erie Station Road, being a single parcel with Tax ID No. 189.01-1-19.2, from Industrial (with Specifics) to Residential, R-2-15, or as more particularly described in plans on file in the Town Clerk’s Office; and 

• Special Use Permit Application No. 2025-021: Erie Station / West Henrietta Road Multifamily Development by FSI 5500 LLC – Erie Station Road (near 5500 West Henrietta Road), to construct a multifamily housing development, in an Industrial Zoned District (proposed to be rezoned to a Residential R-2-15 Zoned District), Tax Account No. 189.01-1-19.2, or as more particularly described in plans on file in the Town Clerk’s Office.

APPROVED - The public hearing was closed, a SEQR Negative Declaration was issued, the Rezone was approved, and the Special Use Permit was approved. The Special Use Permit approval resolution is attached below in files.

Tuesday, October 21, 2025 Planning Board Meeting - 6:00 p.m.

Application No. 25-006        Delphi Housing Development – For final site plan approval of a proposed 300-unit multi-family apartment complex on approximately 40.37 acres located at what will be known as 5560 West Henrietta Road in a Residential R-2-15 Zoned District. Tax Account No. 189.01-1-19.21.

Wednesday, December 10, 2025 Special Use Permit Public Hearing

A meeting will be held on Wednesday, December 10, 2025 at 6:00 p.m., before the Henrietta Town Board to hear all persons with regards to the following Application for a Special Use Permit:

Application No. 2025-025: Delphi Housing Development (formerly Erie Station / West Henrietta Road Multifamily Development by FSI 5500 LLC) – 5560 West Henrietta Road to construct a multifamily housing development with a building height of 41’, whereas Town Code allows 35’, in a Residential R-2-15 Zoned District, Tax Account No. 189.01-1-19.21 (previously Tax Account No. 189.01-1-19.2), or as more particularly described in plans on file in the Town Clerk’s Office. (Approval for the development was granted on July 2, 2025 with Application No. SP2025-021.)

APPROVED - The public hearing was closed and the application was approved by Resolution, which is attached in the files below.
